Wash Club Terms of Agreement

By purchasing, activating, or using an Unlimited Wash Club Membership (“Membership”), you enter into a legally binding recurring payment agreement with Hang 5 Carwash (ABN 82 465 706 211).

Your subscription is governed by the following Terms and Conditions.


1. Recurring Payment Authorisation

1.1 By enrolling, you expressly acknowledge and agree that your selected Membership plan is a recurring monthly subscription.

1.2 You authorise Hang 5 Carwash to automatically charge the credit/debit card you provided every 30 days from the original purchase date until you cancel through the required method detailed below.

1.3 You understand and agree that charges will continue indefinitely, on a recurring basis, until you submit a valid cancellation through the Manage Membership Portal.

1.4 By completing the checkout process, you agree that you have been clearly informed of:

  • the recurring nature of your Membership

  • the billing frequency (every 30 days)

  • the cancellation method

  • the no-refund policy

  • the failed payment retry process


2. Membership Benefits & Entitlements

2.1 Your Membership entitles you to unlimited automated car washes for one registered vehicle during Hang 5 Car Wash’s normal operating hours.

2.2 Your Membership includes access to complimentary vacuum stations, when available.

2.3 Benefits apply only to the wash package level selected at the time of purchase.

2.4 Add-ons, upgrades, or specialty products are not included unless explicitly stated.

2.5 Membership benefits apply solely to the nominated licence plate on your account and cannot be transferred to another vehicle.


3. Membership Account Control Features

3.1 Through your Manage Membership Portal, you have the ability to:

  • Cancel your Membership (must be done at least 24 hours before renewal)

  • Suspend your Membership and payments (where suspension is enabled)

  • Update or change your credit/debit card information at any time

  • Upgrade or downgrade your Membership plan

  • Reactivate a cancelled or expired Membership

  • Add additional vehicles under your account at the applicable rate

  • View billing history, renewal dates, payment status, and account activity

3.2 These features are the customer’s responsibility to manage. Failure to use the portal does not exempt you from billing obligations.


4. Failed Payments, Retry Schedule & Automatic Cancellation

4.1 If a renewal transaction declines, the Membership enters Declined/Payment Failed status and access may be suspended.

4.2 Hang 5 Carwash will automatically retry the payment for up to 20 days.

4.3 Access is restored once a successful payment is received.

4.4 If payment is not successfully collected within 30 days, your Membership will automatically cancel.

4.5 Automatic cancellation for non-payment does not constitute a refund and does not waive charges owed.


5. Accepted Method of Cancellation

5.1 To cancel, you must log in to your Manage Membership Portal and submit a cancellation request.
This is the exclusive and only valid method of cancelling.

5.2 Cancellations must be completed at least 24 hours before your next billing date.

5.3 The following methods are not valid cancellations under any circumstances:

  • phone calls

  • text messages

  • emails

  • voicemails

  • verbal/in-person requests to staff

  • failed payments

  • assuming the Membership cancels on its own

5.4 If you cannot access your account, you must contact contact@hang5carwash.com.au immediately.
Failure to do so does not constitute cancellation.

5.5 If you fail to cancel through the portal, you accept full responsibility for all future charges.


6. Refund, Credit & Backdating Policy

6.1

6.1 No refunds, credits, backdating, or partial reimbursements will be issued for:

  • unused days or unused months

  • not using the service

  • change of mind

  • failing to cancel before renewal

  • duplicate memberships purchased by you

  • banking or payment method issues

  • attempts to cancel using non-approved methods

6.2 This policy is disclosed during sign-up, on receipts, and in your Terms of Agreement.


7. Membership Use Requirements & Restrictions

7.1 Each Membership is valid for one nominated vehicle only.

7.2 Memberships cannot be shared, transferred, reassigned, or used for commercial purposes unless authorised.

7.3 Tampering, sharing, or fraudulent use may result in termination without refund.


8. Service Availability Disclosure

8.1 Membership benefits apply only during standard operating hours.

8.2 Service may be unavailable due to:

  • weather

  • maintenance or repair

  • equipment malfunction

  • power outages

  • safety closures

8.3 No refunds or credits are issued for downtime.


9. Pricing & Terms Updates

9.1 Hang 5 Carwash may update pricing or terms with notice via:

  • website

  • email

  • customer portal

9.2 Continued use after notice constitutes acceptance.


10. Liability Waiver & Conditions of Entry

By enrolling, you agree to all posted Conditions of Entry, including limitations of liability for:

  • pre-existing vehicle damage

  • aftermarket accessories

  • loose or improperly secured vehicle components

  • incompatible vehicles

  • failure to follow posted instructions

You are responsible for ensuring your vehicle meets all requirements.


11. Confirmation of Agreement

By completing your purchase, you confirm that:

  • recurring billing terms were clearly disclosed

  • you understand and agree to the required cancellation method

  • you authorise ongoing charges until cancelled through your portal

  • failed payments do not cancel your plan

  • you understand the no-refund policy

  • you accept these terms as binding and enforceable
