Wash Club Terms of Agreement

These Wash Club Terms of Agreement (“Terms”) apply to all Wash Club memberships and form a binding agreement between the member (“you”, “your”) and Hang 5 Carwash (“we”, “us”, “our”).

By purchasing, activating, or using a Wash Club membership, you confirm that you have read, understood, and agreed to these Terms and the Car Wash Conditions of Entry, available at www.hang5carwash.com.au.


1. Membership Overview

The Wash Club is a recurring subscription service that provides ongoing access to car wash services for registered vehicle(s) in accordance with these Terms.

Wash Club Memberships may be offered on a monthly or annual recurring billing basis, as selected at the time of purchase.

Memberships provide access to services, not a guarantee of usage. Lack of use does not pause, suspend, or invalidate a recurring charge and does not entitle the member to a refund or credit.


2. Membership Inclusions

An active Wash Club membership entitles each registered vehicle to:

  • Unlimited car washes during normal operating hours at the nominated location; and

  • Complimentary use of on-site self-serve vacuum facilities, where available.

All services are subject to site availability, queue capacity, safety requirements, posted site rules, and operational conditions.


3. Eligible Vehicle Use

Wash Club memberships may be used for:

  • Personal and private vehicles

  • Business or company-registered vehicles

  • Rideshare vehicles (including Uber and similar services)

  • Taxis and commercial passenger vehicles

Provided each vehicle is individually registered to the membership account and used in accordance with these Terms and the Car Wash Conditions of Entry.

Vehicle sharing, licence plate manipulation, or unauthorised use of unregistered vehicles is not permitted.


4. Vehicle Registration, LPR & Additional Vehicles

Wash Club access is managed using a Licence Plate Recognition (LPR) system.

Each membership includes one registered vehicle licence plate by default. Additional vehicles may be added to the same membership account for an additional recurring fee per vehicle, as advertised at the time of enrolment or amendment.

Each registered vehicle:

  • Is treated as a separate membership entitlement

  • Is billed on an ongoing recurring basis (monthly or annual, as applicable)

  • Receives its own unlimited wash access and complimentary vacuum use

It is the member’s responsibility to ensure licence plate details remain accurate and current. Access may be denied where the detected licence plate does not match a registered vehicle on the account.

4.1 Misuse, Fraud & Enforcement

We reserve the right to suspend or terminate a Wash Club membership without refund for misuse, sharing, fraud, tampering, or breach of these Terms, including use by unregistered vehicles or licence plate manipulation.


5. Service Availability

Wash Club services may be temporarily unavailable due to weather conditions, maintenance, equipment faults, safety concerns, power outages, staffing requirements, public holidays, or other operational reasons.

This includes full or partial closures on select public holidays (including Christmas Day, New Year’s Day, Good Friday, and ANZAC Day), as well as any other days where trading hours are restricted or suspended in accordance with applicable laws or operational requirements.

Temporary interruptions or closures do not constitute a breach of this agreement and do not entitle the member to refunds, credits, extensions, or compensation, except where required under Australian Consumer Law.


6. No Guaranteed Access or Wait Times

Wash Club memberships provide access to services but do not guarantee entry at any specific time.

Wait times may vary based on demand, queue volume, and operational conditions. No priority access is provided unless expressly stated.


7. Vacuum Use Conditions

Complimentary vacuum use is provided on a self-serve basis and subject to availability and posted site rules.

Vacuum use may be limited (including time limits per visit) to ensure fair access and manage congestion. Access may be monitored and restricted during peak periods, maintenance, or safety-related situations.

Failure to comply with vacuum usage rules may result in restricted access to vacuum facilities.


8. Access-Based Service / No Cash Value

Wash Club benefits:

  • Have no cash value

  • Are not redeemable or exchangeable

  • Do not accumulate if unused

The Wash Club is an access-based service, not a fixed quantity of washes or vacuum time. Charges apply in exchange for continued access regardless of actual usage.


9. Billing, Payments & Cancellation

9.1 Monthly Memberships

Monthly Wash Club Membership fees are charged on a recurring 30-day billing cycle to the payment method provided at enrolment.

Memberships automatically renew every 30 days unless cancelled.

9.2 Annual Memberships

Where an Annual Wash Club Membership is purchased, the membership fee is billed in advance on a recurring 12-month billing cycle.

Annual Memberships automatically renew every 12 months unless cancelled by the member via the Manage Membership Portal before the next scheduled renewal date.

Once billed, the annual membership period remains active for the full 12-month term and is not refundable in whole or in part, except where required under Australian Consumer Law.

9.3 Authorisation & Responsibility

By enrolling, you authorise us to automatically debit all applicable membership fees, including fees for any additional registered vehicles, until cancelled.

Cancellations must be completed via the Manage Membership Portal before the next scheduled billing date to avoid being charged for the subsequent billing period.

Once billed, the current billing period remains active and is not refundable, except where required under Australian Consumer Law.

9.4 Cancellation Responsibility

It is the member’s responsibility to ensure cancellation is completed successfully via the Manage Membership Portal. Failure to cancel prior to renewal will result in the next billing cycle being charged.

9.5 Chargebacks Do Not Constitute Cancellation

Initiating a chargeback, payment dispute, or card reversal does not constitute valid cancellation notice and does not release the member from responsibility for charges incurred prior to cancellation.

9.6 Effect of Chargebacks

Where a chargeback is initiated for a valid recurring charge, we reserve the right to immediately suspend or cancel the associated Wash Club membership.

9.7 Email or Verbal Requests Do Not Constitute Cancellation

Requests to cancel submitted by email, to on-site staff, or through any method other than the Manage Membership Portal do not constitute cancellation unless and until the cancellation is successfully completed via the Manage Membership Portal.


10. Failed Payments, Retries & Suspension

If a payment attempt fails due to insufficient funds, expired cards, or invalid payment details:

  • We may re-attempt payment using the same payment method; and

  • Membership access may be temporarily suspended during this period.

Suspension does not pause billing obligations or extend the membership term. We reserve the right to cancel memberships for ongoing or unresolved payment failures.


11. Notices & Communications

We may communicate with members via email and/or SMS for purposes including billing notices, payment issues, membership status, service updates, and account management.

All notices relating to cancellation, billing, payment issues, or membership changes must be submitted via the Manage Membership Portal or by email to contact@hang5carwash.com.au.

Verbal requests to on-site staff, social media messages, or third-party communications do not constitute valid notice.

11.1 No Reliance on Staff Statements

Any verbal or informal information provided by staff is general assistance only and does not vary these Terms. Members must rely on on-screen disclosures, receipt information, and the published Wash Club Terms of Agreement.


12. Evidence & Records

Our electronic records, including LPR logs, transaction records, and membership system data, constitute evidence of service availability, access, and billing activity unless proven otherwise.


13. Location Limitation

Wash Club memberships are valid only at the nominated Hang 5 Carwash location unless expressly stated otherwise.


14. Conditions of Entry

All vehicles using the Wash Club must comply with the Car Wash Conditions of Entry, including vehicle eligibility, safety requirements, and operational instructions.


15. Limitation of Liability

To the fullest extent permitted by Australian Consumer Law, Hang 5 Carwash excludes liability for any loss or damage arising from use of the Wash Club, except where liability cannot be excluded by law.


16. Limited Goodwill Refund (Discretionary)

At the sole discretion of Hang 5 Carwash, a maximum of two (2) monthly renewal payments may be refunded as a goodwill gesture only, provided:

  • A request is submitted by email to contact@hang5carwash.com.au within 7 days of the last renewal payment;

  • No wash redemptions have occurred during the applicable period; and

  • The original payment method remains valid and refundable.

This clause does not create an entitlement or contractual right to a refund.


17. Electronic Acceptance

Acceptance of these Terms may be recorded electronically at the time of purchase, including via a pay station or digital interface.

Any electronic mark, stylus input, initials, or similar acknowledgement constitutes valid acceptance and does not require a handwritten or recognisable signature.

Completion of the sign-up process confirms acceptance regardless of the form of electronic signature used.


18. Changes to Terms

We may update these Terms or adjust pricing from time to time. Where changes are material, reasonable notice will be provided. Continued use of the Wash Club constitutes acceptance of the updated Terms.


19. Governing Law

These Terms are governed by the laws of the State or Territory in which the car wash operates and applicable Australian law.
